TV presenters' responsibility to control hate

 speech in debates: Supreme Court

New Delhi: The Supreme Court has expressed deep displeasure over hate speech in news channels and asked why the government is a silent spectator and is there any intention to implement laws as per the recommendations of the Law Commission to prevent such incidents? I asked. The Supreme Court has said that it is the duty of anchors to prevent hate speech in news channels' talk shows. A bench comprising Justices KM Joseph and Hrishikesh Roy opined that an institutional mechanism is needed to control hate speech. The role of news anchors is so important that hateful statements such as these are unchecked, neither in the mainstream media nor on social media. Mainstream news outlets still hold sway. The court said that it is the responsibility of TV presenters to control hate speech in debates and in many cases those who want to speak are muted.

Parties cannot be banned for hate speech,

 no definition under law:

 Election Commission

New Delhi: The Election Commission of India has told the Supreme Court that it has no legal authority to cancel the registration of candidates or political parties on the grounds of hate speech. In an affidavit submitted to the Supreme Court, it said that there is no definition of hate speech under Indian law. It is explained in the affidavit that since there are no laws to prevent the spread of hate speech and rumors by politicians and political parties during elections, the Election Commission has instructed the leaders of the political parties not to make any statements or words that disturb the harmony in the society under the Indian Penal Code and RP Act 1951. This has been said in the affidavit submitted by the Election Commission in response to BJP leader Ashwin Kumar's request to curb hate speech. In the case of Election Commission Affidavit, Pravasi Bhilai Sangathan v. Union of India (2014), the Supreme Court referred to the question of whether the Law Commission should be empowered to re-recognise a political party or disqualify its members for hate speech. The Supreme Court asked the Law Commission to make recommendations to Parliament to define hate speech and prevent intimidation. But the Election Commission pointed out in the affidavit that the 267th report of the commission did not answer the question of the court. The Election Code of Conduct has been amended and strict action will be taken and show cause notice issued against the candidate or those related to him who have made hate speech. A list of rules to be followed during elections has been prepared. It is stated in the affidavit that there is a lot of publicity about the rules and amendments of the Election Commission and the purpose of this is to reach the candidates contesting the elections and the political parties.
